1. 총칙
본 이용약관(이하 “약관”)은 VIP 프로그램(이하 “프로그램”)의 사용과 관련된 권리와 의무를 규정합니다. 본 약관은 대한민국 법률, 특히 전자상거래 등에서의 소비자보호에 관한 법률, 약관의 규제에 관한 법률, 정보통신망 이용촉진 및 정보보호 등에 관한 법률을 준수합니다. 소비자는 프로그램 구매 시 본 약관에 동의한 것으로 간주됩니다.
2. 회사의 책임
회사는 프로그램의 정상적인 작동을 위해 최선을 다해 노력합니다. 회사는 프로그램 사용으로 인해 발생하는 어떠한 손해(직접적, 간접적, 특별, 부수적 손해 포함)에 대해 책임을 지지 않습니다. 이는 민법 제750조 및 상법 제663조에 따라 회사의 책임을 제한하는 조항입니다.
3. 환불 정책
본 프로그램은 구매 후 환불이 불가합니다. 이는 전자상거래 등에서의 소비자보호에 관한 법률 제17조 제2항에 따라, 디지털 콘텐츠의 특성상 사용 시 금전적 이익이 발생할 가능성과 데이터 복제 가능성으로 인해 청약철회가 제한됩니다. 소비자는 구매 전에 본 약관을 충분히 검토하고, 환불 불가 정책에 동의한 후 구매해야 합니다. 회사는 구매 과정에서 환불 불가 정책을 명확히 고지하며, 동의 없이는 구매가 진행되지 않습니다.
4. 프로그램 계정 및 불법 사용 금지
소비자는 프로그램의 계정을 다른 사람과 공유하거나, 프로그램을 무단으로 복제, 해킹, 역공학, 또는 기타 불법적인 방법으로 사용해서는 안 됩니다. 이러한 행위는 "정보통신망 이용촉진 및 정보보호 등에 관한 법률" 제28조(불법 접근 금지) 및 "저작권법" 제2조(저작물 정의), 제46조(저작권 침해 금지)를 위반하는 것입니다. 소비자는 계정 보안을 철저히 관리해야 하며, 계정 도용, 무단 복제, 해킹 등으로 인해 발생한 손해에 대해 회사의 고의 또는 중대한 과실이 없는 한 회사는 책임을 지지 않습니다.
불법 사용에 대한 권고: 소비자는 본 약관에 명시된 용도 이외로 프로그램을 사용하거나, 불법적으로 접근, 수정, 배포, 복제해서는 안 됩니다. 이를 위반할 경우, 관리자는 "전자상거래 등에서의 소비자보호에 관한 법률" 제13조(계약 이행 보장) 및 "약관의 규제에 관한 법률" 제6조(계약 해지 권한)에 따라 계정 사용 제한, 계정 삭제, 서비스 중단 등의 조치를 취할 수 있습니다. 관리자는 불법 사용이 확인되면 소비자에게 전자우편 또는 공지사항을 통해 사전에 통지한 후 조치를 진행하며, 시스템 보안 위협이나 다른 사용자에게 피해가 우려되는 긴급 상황에서는 사전 통지 없이 즉시 조치를 취할 수 있습니다. 불법 사용으로 인한 모든 책임(법적, 금전적 손해 포함)은 소비자가 부담하며, 회사는 이를 근거로 민사 및 형사상 법적 조치를 취할 수 있습니다. 소비자는 "저작권법" 및 "정보통신망 이용촉진 및 정보보호 등에 관한 법률"을 준수해야 하며, 불법 행위로 인해 제3자에게 손해가 발생할 경우 소비자가 전적인 책임을 부담합니다.
5. 소비자 권리
소비자는 프로그램 구매 시 본 약관에 동의함으로써, 전자상거래 등에서의 소비자보호에 관한 법률에 따른 청약철회권 등 일부 소비자 권리가 제한될 수 있음에 동의합니다.
6. 약관의 효력
본 약관은 2025년 5월 25일부터 시행됩니다. 약관의 일부가 법령에 의해 무효로 판단되더라도, 나머지 조항은 계속 유효합니다.
1. General Provisions
These Terms and Conditions (hereinafter "Terms") govern the rights and obligations related to the use of the VIP Program (hereinafter "Program"). These Terms comply with Swiss law, in particular the Swiss Code of Obligations (CO) and the Federal Act on Data Protection (FADP). By purchasing the Program, the user is deemed to have agreed to these Terms.
2. Company's Liability
The company endeavors to ensure the proper functioning of the Program. The company shall not be liable for any damages (direct, indirect, special, or consequential) arising from the use of the Program, except in cases of intentional misconduct or gross negligence, as per Article 100 CO.
3. Refund Policy
The Program is non-refundable after purchase. Due to the nature of digital content, which may generate financial benefits and is susceptible to duplication, no right of withdrawal is granted, in accordance with Article 29 CO and general principles of Swiss contract law. Users must carefully review these Terms and agree to the non-refunded policy before purchasing. The company clearly discloses the non-refunded policy during the purchase process, and purchases cannot proceed without user consent.
4. Program Account and Prohibition of Illegal Use
Users may not share their Program account with others or engage in unauthorized duplication, hacking, reverse engineering, or any other illegal use of the Program. Such actions violate the Federal Act on Copyright and Related Rights (CopA) and the Federal Act on Data Protection (FADP). Users are responsible for maintaining the security of their accounts, and the company is not liable for damages resulting from account theft, unauthorized duplication, or hacking, except in cases of the company's intentional misconduct or gross negligence.
Prohibition of Illegal Use: Users must not use the Program for purposes other than those specified in these Terms or engage in illegal access, modification, distribution, or duplication. Violations may result in account restrictions, account deletion, or service termination, as permitted under Article 27 CO (contractual penalties). The company may notify users via email or public notice before taking action, except in urgent cases involving system security threats or potential harm to other users, where immediate action may be taken without prior notice. Users bear full responsibility for any legal or financial damages resulting from illegal use, and the company may pursue civil and criminal remedies. Users must comply with the CopA and FADP, and any harm caused to third parties due to illegal actions is the sole responsibility of the user.
5. User Rights
By agreeing to these Terms upon purchasing the Program, users acknowledge that certain rights, such as the right of withdrawal, may be limited under Swiss law, in accordance with Article 29 CO.
6. Validity of Terms
These Terms are effective as of May 25, 2025. If any provision is deemed invalid under applicable law, the remaining provisions shall remain in force.
